Terms & Conditions

Tickets
The Customer should keep their ticket safe as replacements will not be issued. The Customer must show or purchase their ticket as they board. The ticket remains the property of the company and must be produced for inspection and, if requested to do so, be surrendered upon demand to an authorized Company Official. The Customer will not be permitted to use any TopView Sightseeing® service without a valid ticket for the entire journey the Customer wishes to make.

Ticket Validity
The Customer should keep their ticket safe as replacements will not be issued. The Customer must show or purchase their ticket as they board. The ticket remains the property of the company and must be produced for inspection and, if requested to do so, be surrendered upon demand to an authorized Company Official. The Customer will not be permitted to use any TopView Sightseeing® service without a valid ticket for the entire journey the Customer wishes to make.

Tickets
The ticket entitles the Customer to use all TopView Sightseeing® services during operational hours for the duration of their pass/ tickets. When the ticket expires the Customer must either leave the tour at the next available opportunity or purchase another ticket. Extensions will not be given. Tickets do not guarantee travel on a specific service or at a specific time.

Lost Tickets
Customers must keep their ticket safe. Customers found traveling without a valid ticket will be charged the full ticket price for a replacement ticket. TopView Sightseeing® does not issue a re-print copy to a lost or stolen ticket.

Departure Points and Times
TopView Sightseeing® endeavors to provide departure points and times for the service which are as accurate as possible. However, we reserve the right to vary such departure points and times without notice, as circumstances require.

Tour Route
TopView Sightseeing® reserves the right to deviate from the route of a service in the event of marches, parades, or where reasonably prudent to do so in the light of circumstances beyond TopView Sightseeing® control.

Buses and Bus Saftey
While the TopView Sightseeing® endeavors to operate its open-top double-decker buses, it reserves the right to operate closed-top double-decker buses from time to time, especially in bad weather. During busy times, seating cannot be guaranteed on either deck. TopView Sightseeing® reserves the right to refuse access to travel on a particular departure should circumstance be deemed to compromise tour safety. For safety reasons, all Customers on the upper deck are required to remain seated while the bus is in motion.

Refunds
TopView Sightseeing® does not issue refunds on any used or unused tickets. There are no refunds or exchanges for lost or stolen tickets.

Refunds will not be given for the following issues:

  • Bad weather, if the bus is operating
  • Complaints about traffic or buses taking a long time to arrive
  • Long lines for a bus
  • Employee complaints (other than in extraordinary cases determined by management)
  • Bus temperature was too hot/too cold
  • Complaints relating to other attractions included in packages
  • Audio issues
  • Tickets purchased through third-party suppliers
  • Last minute trip cancelations

Customer may receive a refund if:

  • TopView Sightseeing® is completely unable to operate 
  • A customer's credit card was charged more than once for the same transaction
  • TopView Sightseeing® reserves the right to offer a partial refund in all circumstances
  • If a refund is agreed TopView Sightseeing® may charge a 15% administrative fee

Accident or Loss
Please take care of all personal property. TopView Sightseeing® will not be liable for any loss, damage, delay, inconvenience, direct or consequential loss, however, caused, unless due to negligence by TopView Sightseeing®, in which case our liability is limited (except for death or personal injury) for damages to a maximum of the refund of the ticket price.

Alcohol
The consumption of alcohol is prohibited on the bus at all times.

Customer Conduct
We may at our discretion require any person to alight from a tour if we deem his/her conduct offensive or a nuisance to other passengers, or if behaving in such a way as to constitute a risk to his/her safety or to the safety of other passengers, and we shall have no further liability.

New York Water Tours
All schedules are for advising purposes only. New York Water Tours is not responsible for any delays, schedule changes, or service cancellation.
